Legality and retention for employment documents

Employment paperwork is kept for years and occasionally read by people who were not there. ESIGN and UETA both set out what an electronic record needs in order to stand up later, and every send carries it.

The candidate agrees to sign electronically

Before anything is signed, the candidate is shown the electronic records disclosure and agrees to it. Their acceptance, the time, and the wording they saw are all captured, which is what ESIGN means by consent and intent to sign.

Attribution

The signature is tied to the person

The certificate of completion records the signer name, the email the link was opened from, timestamps for every view and signature, and the device used. UETA calls this attribution, and it is the part that answers who signed this, later.

Both ESIGN and UETA ask that an electronic record can be retained and accurately reproduced. The finished document is sealed, so any later change is detectable, and it opens as a plain PDF in any reader without needing us.
